How quickly can an intervention order be obtained?

It defines physical violence, economic abuse, sexual offences and coercive control, and outlines legal pathways such as intervention orders to protect affected family members in intimate personal relationships or domestic partnerships.

What is a family violence safety notice?

A Family Violence Safety Notice is a temporary court order issued by a police officer when someone is at risk before their court date. It offers protection until the Magistrates' Court can consider a formal intervention order, and can legally restrict the person accused from approaching or contacting you.

Are you able to attend court with me for intervention order proceedings?

What evidence is required for an intervention order?

You don’t need to prove your case beyond a reasonable doubt like with a criminal matter, but you must show that family violence occurred and you feel fearful that it may happen again. Evidence required can include police reports, messages, photos or witness accounts.

How does family violence affect parenting matters?

The Federal Circuit and Family Court of Australia, which hear family matters, are obligated to prioritise the best interests of children. If a domestic partner has committed family violence, it can significantly affect parenting matters, including care and visitation. The court may limit or supervise contact with the abusive partner to ensure the child's emotional and physical safety.
